Service Terms

These terms apply to any service booked through TopV.gg. TopV is a neutral technical intermediary: it connects streamers and clients, never receives the service price, and does not arbitrate disputes.
1. Purpose
These Terms (the "Terms") govern the use of the service-booking feature between streamers and clients on TopV.gg. They apply to any service listed, booked or delivered through the Prestations Marketplace feature.
2. TopV's role — neutral intermediary
TopV acts as a technical intermediary connecting a streamer (the "Provider") and a client (the "Client"). TopV is not a party to the service contract between them. TopV does not perform any service, does not supervise any stream and does not control the quality of delivery.
Payment for the service itself is agreed and made directly between the Client and the Provider, outside of TopV. TopV does not receive the service price and is not a holder of any funds.
3. TopV fee
TopV charges a flat supervision fee, added to the net price set by the Provider. The fee is 5% of the net price, with a 5€ floor. It is authorized by the Client at booking time via Stripe (the card is placed on hold, with no immediate debit) and only captured once the Provider accepts the request.
The fee compensates the intermediation service: hosting of the listing, eligibility verification of the Client, archiving of exchanges, provision of the validation workflow and review publication.
The fee becomes definitively earned by TopV as soon as the Provider confirms receipt of the service payment. At that point, no refund is possible, including in the event of a later dispute over the quality of delivery.
4. Booking workflow
- The Client submits a request (date, message, context) and authorizes the TopV fee on their card (hold without immediate debit).
- The Provider has 7 days to accept or refuse. On refusal or no response, the Stripe authorization is released and the Client's card is never debited.
- If the Provider accepts, the fee is captured (actual debit) at the moment of acceptance.
- Once accepted, the Provider and Client agree on payment for the service outside of TopV.
- The Provider confirms receipt of payment in the dashboard — the fee then becomes earned.
- The Provider marks the service as delivered. The Client then has 7 days to validate or report a dispute.
- Without Client action within 7 days, the service is automatically validated and appears in the Provider's public portfolio.
5. Cancellation and refund
The Stripe authorization is released without debit in the following cases: refusal by the Provider, request expiration after 7 days, cancellation by the Provider before acceptance. Once the fee has been captured (after acceptance), any subsequent cancellation triggers a standard Stripe refund.
No TopV fee refund is possible once the service is marked as "payment received" by the Provider. The cancellation policy applicable to the service price itself (24H / 48H / 72H / none) is governed solely by the agreement between the Client and the Provider.
6. Disputes — TopV does not arbitrate
TopV does not arbitrate disputes regarding the quality, compliance or payment of the service. Resolution must be reached directly between the Client and the Provider.
TopV may, upon reasoned request, provide a time-stamped log of actions performed on the booking (acceptance, confirmation, delivery, validation). Beyond this documentary assistance, TopV does not act as mediator or arbitrator.
7. Provider obligations
- Accurately describe the service offered (content, duration, deliverables).
- Honor the commitments stated in the service listing, particularly regarding deadlines and format.
- Not accept a booking that cannot be fulfilled under the stated conditions.
- Hold the necessary authorizations (authors, trademarks, platforms) to perform the service.
- Assume their tax and social-security obligations for revenue received directly from the Client.
8. Client obligations
- Pay the service price to the Provider in accordance with the agreement.
- Not require a service contrary to law, to the terms of the relevant streaming platform, or to the dignity of the Provider.
- Validate or contest the service within the allotted time.
- Publish a sincere review based on actual experience.
9. Eligibility
Access to the booking feature is reserved to verified users with a complete profile: FiveM/RedM server owner with a filled-in description, content creator with bio and logo, or TopV administrator. This condition is intended to prevent abusive requests and to protect Providers.
10. Reviews and publication
Any validated service may receive a Client review (rating out of 5 and optional comment). Validated services (manually or automatically) appear in the Provider's public portfolio for reference. Disputed or expired services do not appear in the portfolio.
11. Personal data
Processing of personal data related to the booking (identity, message, dates, fee payment) is described in the TopV Privacy Policy. Data needed for fee invoicing is retained in accordance with legal obligations (10 years for accounting records).
12. Limitation of liability
TopV shall not be liable for non-performance, defective performance, delay or non-payment of the service. TopV's liability is strictly limited to the provision of the technical infrastructure enabling the introduction and the tracking of booking steps. In the event of a proven failure of this infrastructure, TopV's liability is capped at the fee amount received for the relevant booking.
13. Changes to these Terms
TopV reserves the right to modify these Terms at any time. Users will be notified of material changes by dashboard notification. Continued use of the service after modification constitutes acceptance of the new Terms.
14. Applicable law
These Terms are governed by French law. Any dispute relating to the TopV fee or to the use of the introduction service shall be subject to the competent courts of the registered office of Debuskia SASU, subject to mandatory provisions applicable to consumers.
