Terms of Use

1. Purpose

These Terms of Use govern access to and use of the TopV Marketplace, available at https://topv.gg/marketplace. The Marketplace is an editorial aggregation and listing service for products and services for the FiveM and RedM ecosystem (scripts, MLOs, vehicles, hosting, bots, services).

2. Nature of the Service

TopV is not a reseller. The Marketplace lists products that are hosted and sold by third parties (notably via Tebex). All transactions, payments, digital delivery and licensing are solely the responsibility of the third-party creator and the third-party platform. TopV receives no payment for these transactions.

When a visitor clicks a product link, they are redirected to the creator's store. The transaction is then concluded under the terms of that store.

3. Accounts and Registration

Registration on TopV is performed via Discord OAuth. The user warrants the accuracy of the information provided and is responsible for keeping their account secure. TopV reserves the right to suspend or delete any account in case of violation of these Terms, proven fraud or abusive behavior.

4. Reviews and Moderation

Reviews published on the Marketplace are written by authenticated users. Each review is subject to automated (fraud, duplicate and suspicious content detection) and human moderation. TopV reserves the right to refuse, remove or flag any review that is contrary to law, decency or these Terms.

The user undertakes to publish reviews based on actual experience. Posting fake or paid reviews, or reviews intended to harm a creator, is strictly prohibited and may result in account suspension.

In accordance with Article L.111-7-2 of the French Consumer Code, TopV indicates for each review whether the purchase has been verified ("Verified purchase" badge) using affiliate click tracking and a minimum 7-day delay.

5. Creator Obligations

• Provide accurate, up-to-date and non-misleading information about their products.
• Hold all necessary rights or licenses for the content published (scripts, images, descriptions).
• Not publish products infringing the rights of a third party, notably Rockstar Games, Take-Two Interactive or Cfx.re.
• Respond to reviews within a reasonable time and in a respectful manner.
• Promptly notify TopV of any substantial change (store change, end of support, product withdrawal).

6. Visibility, Ranking and Subscriptions

Default ranking combines several criteria: TopV score, review freshness, conversion rate, and creator subscription tier (LEGEND, ELITE, BUSINESS, PRO, FREE). Premium positions granted by paid subscriptions are clearly disclosed. The Marketplace does not accept payment to individually modify the ranking of a specific product.

7. Affiliate Links

Some outbound links may be tracked for analytical purposes (purchase verification, editorial performance measurement). This tracking does not change the price paid by the visitor or the creator's sale terms.

8. Intellectual Property

The design, code, editorial tools and classification system of the Marketplace are the exclusive property of Debuskia SASU. Third-party trademarks (creators, hosts, platforms) remain the property of their respective owners. Any unauthorized reproduction is prohibited.

9. Limitation of Liability

TopV acts as a technical and editorial intermediary. TopV cannot be held liable for the quality, operation, security or compliance of listed products, or for disputes between buyers and creators. Any dispute must be settled directly between the buyer and the creator or the payment platform used.

10. Changes to these Terms

TopV reserves the right to modify these Terms at any time. Users will be notified of substantial changes by email or dashboard notification. Continued use of the Marketplace after modification constitutes acceptance of the new Terms.

11. Applicable Law and Jurisdiction

These Terms are governed by French law. Any dispute shall be subject to the competent courts of the registered office of Debuskia SASU, subject to mandatory provisions applicable to consumers.
